If you double-click on a source line to set a breakpoint, RVD will always attempt to set a Software (SW) breakpoint if the underlying memory is writable.

You can override the default behaviour by selecting the "Set Break…" option from the RVD "Dsm" or "Src" window context menu. This will allow you to explicitly choose between a Hardware (HW) or Software (SW) instruction breakpoint.
